POLITIKA ZASEBNOSTI ZA KADROVSKE ZADEVE
1. Splošno
V HS PLUS d.o.o. (v nadaljevanju HS PLUS) se zavedamo pomena varstva osebnih podatkov, zato z vašimi podatki ravnamo v skladu z zakoni in predpisi, ki urejajo varstvo osebnih podatkov, zlasti v skladu z vsakokrat veljavnim Zakonom o varstvu osebnih podatkov, Zakonom o elektronskih komunikacijah ter Splošni uredbi EU o varstvu podatkov. HS PLUS kot upravljavec osebnih podatkov posameznikom omogoča, da so seznanjeni z vsemi relevantnimi informacijami, ki se nanašajo na njihove osebne podatke.
2. Upravljalec podatkov
Za varstvo vaših osebnih podatkov je odgovorna HS PLUS, trgovina in storitve d.o.o., Gmajna 8, 1236 Trzin, matična številka: 6579639000, davčna številka: SI 15553442, email: [email protected] .
HS PLUS pridobiva osebne podatke posameznikov iz različnih virov. V večini primerov jih pridobivamo preko prijav na prosta delovna mesta oz. posredovanjem ponudb za zaposlitev.
HS PLUS osebne podatke hrani in varuje, tako da ne prihaja do morebitnih neupravičenih razkritij podatkov nepooblaščenim osebam. HS PLUS se zavezuje, da osebnih podatkov ne bo posredoval, posodil ali prodal tretji osebi brez predhodnega obvestila in pridobitve vaše privolitve, brez ustreznih primernih zaščitnih ukrepov, ter da bo osebne podatke obdelovali zgolj v okviru zakonitih pravnih podlag in izbranih namenov.
HS PLUS zbranih osebnih podatkov ne prenaša oz. ne posreduje v tretje države.

Ta politika zasebnosti za kadrovske zadeve velja za:
- zaposlene pri delodajalcu,
- študente in dijake, ki pri delodajalcu opravljajo delo na podlagi napotnice pooblaščene organizacije, ki opravlja dejavnost posredovanja dela dijakom in študentom,
- potencialne kandidate, ki so se prijavili na katerikoli razpis delodajalca za prosto delovno mesto,
- potencialne kandidate, ki so prošnjo za zaposlitev poslali na kariernem portalu https://jobs.hsplus.si/ ali pisno na naslov podjetja oz. preko e-pošte izven aktualnih razpisov za delovno mesto pri delodajalcu in
- neizbrane kandidate, ki so podali soglasje za hrambo osebnih podatkov, za namene prihodnjega kadrovanja.
3. Namen zbiranja osebnih podatkov
Vsi osebni podatki, ki nam jih posredujete, bodo obravnavani zaupno in bodo uporabljeni zgolj v namene, za katere so bili posredovani. Če bo nastala potreba po nadaljnji obdelavi vaših podatkov za kakršenkoli drug namen, vas bomo predhodno kontaktirali in zaprosili za vaše soglasje.
Nameni, za katere lahko uporabljamo vaše osebne podatke so naslednji:
- Nameni obdelave, ki se nanašajo na delavce:
- sklenitev in izvrševanje pogodbe o zaposlitvi, ki je sklenjena z delodajalcem ter izpolnjevanje drugih obveznosti delodajalca, ki izvirajo iz delovnega razmerja (sem spada npr. obračun in izplačilo plače, plačilo davkov in prispevkov…),
- nadzor nad izpolnjevanjem obveznosti, ki za posameznega delavca izvirajo iz delovnega razmerja ter vodenje disciplinskih postopkov, postopkov odpovedi pogodbe o zaposlitvi in sodnih postopkov zoper delavca,
- vodenje evidenc o delavcih, ki smo jih dolžni voditi na podlagi zakona,
- sklenitev in izvrševanje drugih pogodb z zaposlenimi (npr. pogodba o izobraževanju, ipd.) ter vodenje evidenc, ki izhajajo iz takšnih pogodb (npr. evidenca službenih vozil in avtomobilov),
- posredovanje osebnih podatkov delavca tretjim osebam, kadar za to obstaja pravna podlaga.
Nameni, ki se nanašajo na pogodbo o zaposlitvi in/ali zaposlene, se smiselno uporabljajo tudi za delavce, ki opravljajo delo kot študentje ali dijaki.
- Nameni obdelave, ki se nanašajo na kandidate:
- obdelava osebnih podatkov, ki jih posreduje kandidat v okviru zaposlitvenega postopka, ki teče pri delodajalcu ( npr. življenjepis, motivacijsko pismo, podatki, ki nam jih posredujete ob vlogi za zaposlitev) z namenom izbrati ustreznega kandidata za prosto delovno mesto,
- obdelava osebnih podatkov, ki jih posreduje kandidat preko kariernega portala www.jobs.hsplus.si, z namenom ugotoviti ali je kandidat ustrezen za morebitno razpisano prosto delovno mesto oz. ali gre za kandidata, ki ima potencial za zaposlitev v bližnji prihodnosti (v slednjem primeru, vas bomo za hrambo podatkov prosili za privolitev),
- obdelava osebnih podatkov, ki jih posreduje kandidat pisno na naslov podjetja oz. preko e-pošte izven aktualnih razpisov za delovno mesto pri delodajalcu, z namenom ugotoviti ali je kandidat ustrezen za morebitno razpisano prosto delovno mesto oz. ali gre za kandidata, ki ima potencial za zaposlitev v bližnji prihodnosti (v slednjem primeru, vas bomo za hrambo podatkov prosili za privolitev),
- hramba podatkov potencialnih kandidatov, ki so svoje osebne podatke posredovali na podlagi katere izmed zgornjih treh alinej.Hramba podatkov potencialnih kandidatov, je možna le ob predhodni privolitvi potencialnega kandidata.
4. Katere vrste osebnih podatkov HS PLUS zbira in obdeluje
HS PLUS zbira in obdeluje naslednje vrste osebnih podatkov:
- Vrste osebnih podatkov, ki jih zbiramo v postopku zaposlovanja:
- podatki, ki omogočajo vašo identifikacijo: ime, priimek, datum in kraj rojstva;
- informacije, ki ste jih navedli, da bi lahko stopili v stik z vami in omogočili postopek zaposlovanja: vaš naslov (ulica, poštna številka, mesto, država), telefonska številka, e-poštni naslov, Microsoft Teams itd;
- informacije, ki ste nam jih posredovali, da bi lahko preverili vašo primernost v skladu z merili za izbor, določenimi v objavi prostega delovnega mesta: izobrazba in usposabljanje (pridobljena diploma), delovne izkušnje (naziv delovnega mesta, trajanje, ime podjetja, vrsta podjetja in spletni naslov podjetja (neobvezno), glavne naloge in odgovornosti), jezikovne in z delom povezane spretnosti in kompetence;
- informacije, ki ste jih navedli v življenjepisu, motivacijskem in/ali priporočilnem pismu;
- informacije, ki ste jih navedli na razgovoru za zaposlitev;
- v primeru sprejemnega preizkusa: rezultate pisnih in ustnih preizkusov;
- evidenca o vašem napredovanju v postopku zaposlovanja.
V obsegu, ki ga dovoljuje veljavna zakonodaja, HS PLUS lahko pridobiva informacije o vaši izobrazbi in poklicnem znanju, ki so na voljo v javno dostopnih virih, kot so poslovni in zaposlitveni družbeni mediji (LinkedIn ali podobni). Poleg tega lahko informacije o vas pridobimo tudi iz drugih virov, kot so zaposlovalci ali druga spletna mesta na internetu, ob upoštevanju obvestil o zasebnosti teh tretjih oseb.
- Vrste osebnih podatkov v okviru delovnega razmerja:
- Evidenca o zaposlenih delavcih,
- Evidenca podatkov o osebah, ki opravljajo delo na podlagi napotnice pooblaščene organizacije, ki opravlja dejavnost posredovanja dela dijakom in študentom,
- Evidenca podatkov o kandidatih za štipendijo in štipendistih,
- Evidenca o plačah, potnih nalogih in drugih mesečnih izplačilih,
- Evidenca o izrabi delovnega časa,
- Evidenca o poškodbah pri delu,
- Evidenca o zdravstvenih pregledih,
- Evidenca o izobraževanjih delavcev.
5. Pravne podlage obdelave osebnih podatkov in nameni obdelave
Podlage, na katerih uporabljamo vaše osebne podatke, so naslednje:
- Zakon – vaše osebne podatke obdelujemo, kadar tako določa zakon (sem spada predvsem Zakon o delovnih razmerjih, ki služi kot podlaga za večino obdelav, ki izvirajo iz delovnega razmerja oz. vodenja zaposlitvenih postopkov. Kot podlaga pa lahko služijo tudi drugi zakoni kot npr. Zakon o evidencah na področju dela in socialne varnosti, ki delodajalcu nalaga obveznost vodenja evidenc o zaposlenih).
- Pogodbeni oz. predpogodbeni odnos – kadar osebnih podatkov ne obdelujemo na podlagi zakona, kot podlaga za obdelavo osebnih podatkov lahko služi pogodbeni odnos, v katerem je zaposleni z delodajalcem. S tem je lahko mišljena pogodba o zaposlitvi ali pa kakšna druga pogodba, kot npr. pogodba o izobraževanju. Med take podatke tako sodijo predvsem, zasebna (kontaktna) telefonska številka, zasebni (kontaktni) e-naslov, podatki o izobraževanjih, ipd.).
- Zakoniti interesi – vaše osebne podatke lahko obdelujemo na podlagi naših zakonitih interesov. Vselej kadar bomo vaše osebne podatke obdelovali na podlagi zakonitih interesov, zlasti učinkovite obdelave vaše prijave in nenehnega izboljševanja našega postopka zaposlovanja.
- Vaša izrecna privolitev – občasno vas bomo morda zaprosili za privolitev za uporabo vaših osebnih podatkov za enega ali več namenov. Kadarkoli bo pravna podlaga za obdelavo osebnih podatkov vaša privolitev, vas bomo o tem predhodno obvestili.
- Za privolitev bomo zaprosili kandidate za izpolnitev določenih delov zaposlitvenega obrazca, naše zaposlene pa bomo za privolitev zaprosili pri različnih objavah in obdelovanju podatkov vezanih na delovno razmerje. Prav tako bomo za privolitev zaprosili neizbrane kandidate, katerih osebne podatke želimo hraniti za namene prihodnjega kadrovanja.
- Pri obdelavi vaših osebnih podatkov na podlagi privolitve, je posredovanje osebnih podatkov vedno prostovoljno in brez negativnih posledic za vas. Kljub temu pa vas opozarjamo, da vam določenih storitev brez vaše privolitve ali po preklicu vaše privolitve, ne bomo mogli zagotavljati (npr. hrambe vaših osebnih podatkov z namenom kontaktirati vas, ko se odpre za vas relevantno delovno mesto).
6. Obdobje hrambe
Vse osebne podatke, ki jih obdelujemo hranimo skladno z zakonodajo in le toliko časa, kolikor je potrebno, da dosežemo namene, za katere so bili podatki zbrani.
Kadar čas hrambe osebnih podatkov predpisuje zakon, jih hranimo skladno z določili tega zakona.
Kadar gre za zbiranje in obdelavo osebnih podatkov na podlagi pogodbe, predstavlja čas hrambe podatkov celotno obdobje veljavnosti pogodbe, vključno z jamčevalnimi ali katerikoli drugimi roki, ki izhajajo iz sklenjene pogodbe.
Kadar gre za zbiranje in obdelavo osebnih podatkov na podlagi vaše izrecne privolitve, bomo vaše osebne podatke hranili trajno oz. do preklica. V primeru da pride do izpolnitve namena za katere smo podatke obdelovali, pa bomo vaše podatke izbrisali četudi preklica privolitve ne boste podali.
7. Varnost
Za zaščito osebnih podatkov, ki jih obdelujemo, uporabljamo splošno sprejete standarde tehnične in operativne varnosti. Dostop do osebnih podatkov ima samo pooblaščeno osebje družbe HS PLUS in naših zunanjih ponudnikov storitev (npr. ponudnik programske opreme, ki je potrebna za izvajanje naših postopkov zaposlovanja in vodenja kadrovskih evidenc). Ti zaposleni in tretji ponudniki storitev so zavezani, da te podatke obravnavajo kot zaupne.
Osebne podatke hranimo v pisni obliki (v personalnih mapah, v zaklenjenih omarah) in v računalniški obliki. Naši računalniški sistemi so zaščiteni s tehničnimi in organizacijskimi ukrepi, ki preprečujejo nenamerno ali namerno uničenje, izgubo, poškodbo, spremembo ter nepooblaščeno razkritje ali
8. Vaše pravice
Za zagotovitev poštene in pregledne obdelave vaših osebnih podatkov imate pravico:
- zahtevati dostop do svojih osebnih podatkov. Tako lahko prejmete kopijo osebnih podatkov, ki jih hranimo o vas, in preverite, ali jih obdelujemo zakonito.
- zahtevati popravek osebnih podatkov, ki jih hranimo o vas. To vam omogoča, da popravite morebitne nepopolne ali netočne podatke.
- zahtevati izbris vaših osebnih podatkov. To vam omogoča, da od nas zahtevate izbris ali odstranitev osebnih podatkov, če ni utemeljenega razloga, da bi jih še naprej obdelovali. Prav tako imate pravico zahtevati, da izbrišemo ali odstranimo vaše osebne podatke, če ste uveljavljali pravico do ugovora obdelavi.
- ugovarjati obdelavi vaših osebnih podatkov, kadar se zanašamo na zakonite interese (ali interese tretje osebe) in je v vašem posebnem položaju nekaj, zaradi česar želite ugovarjati obdelavi na tej podlagi.
- zahtevati omejitev obdelave vaših osebnih podatkov. To vam omogoča, da od nas zahtevate, da začasno ustavimo obdelavo osebnih podatkov o vas, če na primer želite, da ugotovimo njihovo točnost ali razlog za njihovo obdelavo.
- zahtevati prenos vaših osebnih podatkov drugi stranki.
- preklicati privolitev, kadar naša obdelava vaših osebnih podatkov temelji na privolitvi.
Vse zahteve v zvezi z uveljavljanjem pravic v zvezi z osebnimi podatki, ki jih obdeluje družba HS PLUS, lahko naslovite pisno na elektronski naslov [email protected]. HS PLUS je dolžna na zahtevo posameznika odgovoriti brez nepotrebnega odlašanja oziroma najpozneje v enem mesecu. Če posameznik meni, da osebni podatki, ki jih je prejel na podlagi zahteve za uveljavitev svojih pravic iz prejšnje točke te Politike zasebnosti za kadrovske zadeve, niso osebni podatki, ki jih je zahteval ali da ni prejel vseh zahtevanih osebnih podatkov, lahko pred vložitvijo pritožbe pri HS PLUS vloži obrazložen ugovor v roku 15 dni. HS PLUS je dolžan o ugovoru odločiti v 5 delovnih dneh.
Zoper zavrnilni odgovor upravljavca je možna pritožba, za reševanje katere je pristojen nadzorni organ – Informacijski pooblaščenec.
9. Kategorije uporabnikov osebnih podatkov
Uporabniki osebnih podatkov so kadrovski oddelek in pogodbeni obdelovalci HS PLUS, ki so na podlagi delovnopravne zakonodaje, pogodb o obdelavi osebnih podatkov ali pogodb o varovanju zaupnih podatkov zavezani k spoštovanju in varovanju osebnih podatkov posameznikov. Uporabniki do osebnih podatkov dostopajo v skladu z dodeljenimi pravicami dostopa do podatkov.
HS PLUS osebne podatke posreduje tudi tretjim osebam, če takšno obveznost posredovanja oziroma razkritja nalaga zakon (na primer Finančna uprava Republike Slovenije, sodišča, policija ipd.).

At HS PLUS d.o.o. (hereinafter referred to as HS PLUS), we are aware of the importance of personal data protection and therefore we treat your data in accordance with the laws and regulations governing the protection of personal data, in particular in accordance with the Personal Data Protection Act, the Electronic Communications Act and the EU General Data Protection Regulation, as applicable from time to time. HS PLUS, as the controller of personal data, provides individuals with the opportunity to be informed of all relevant information relating to their personal data.

HS PLUS obtains personal data about individuals from a variety of sources, in most cases through job applications or job offers.
HS PLUS stores and protects personal data so that there are no unjustified disclosures of data to unauthorised persons. HS PLUS undertakes not to disclose, lend or sell personal data to any third party without prior notification and obtaining your consent, without appropriate suitable safeguards, and to process personal data only within the scope of lawful legal bases and for the purposes chosen.
HS PLUS does not transfer or forward the personal data collected to third countries.

This HR Privacy Policy applies to:
- employees of the employer,
- students who work for an employer on the basis of a referral from an authorised organisation providing work for students,
- potential candidates who have applied for any of the employer’s vacancies,
- potential candidates who have applied for a job on the careers portal https://jobs.hsplus.si/ or by writing to the company or by e-mail outside the employer’s current job vacancies; and
- unsuccessful candidates who have given their consent to the retention of personal data for future recruitment purposes.
3. Purpose of the collection of personal data
Any personal data you provide to us will be treated confidentially and will only be used for the purposes for which it was provided. If there is a need to further process your data for any other purpose, we will contact you in advance and ask for your consent.
The purposes for which we may use your personal data are as follows:
- Purposes of processing relating to workers:
- concluding and enforcing the employment contract with the employer and fulfilling the employer’s other obligations arising out of the employment relationship (e.g. payroll, tax and contribution payments…),
- monitoring the fulfilment of the obligations arising out of the employment relationship, disciplinary proceedings, dismissal proceedings and legal proceedings against the employee,
- keeping the records on workers that we are required to keep by law,
- the conclusion and execution of other contracts with staff (e.g. training contract, etc.) and the keeping of records arising from such contracts (e.g. records of official vehicles and cars),
- the transfer of personal data of the employee to third parties where there is a legal basis for doing so.
The purposes relating to the employment contract and/or employees apply mutatis mutandis also to workers who work as students or pupils.
- Purposes of processing relating to applicants:
- processing of personal data provided by the candidate in the context of the recruitment process with the employer (e.g. CV, cover letter, information you provide us with when applying for a job) in order to select the right candidate for the vacancy,
- processing of personal data provided by the candidate via the career portal www.jobs.hsplus.si in order to determine whether the candidate is suitable for a possible vacancy or whether the candidate has the potential to be recruited in the near future (in the latter case, we will ask for your consent to store the data),
- processing of personal data provided by the candidate in writing to the company address or by email outside of current job vacancies with the employer, in order to determine whether the candidate is suitable for the vacancy or whether the candidate has the potential to be hired in the near future (in the latter case, we will ask for your consent to store the data),
- the retention of data of potential candidates who have provided their personal data on the basis of any of the above three bullet points.The retention of data of potential candidates is only possible with the prior consent of the potential candidate.
4. What types of personal data HS PLUS collects and processes
HS PLUS collects and processes the following types of personal data:
- Types of personal data collected in the recruitment process:
- information that identifies you: first name, surname, date and place of birth;
- the information you have provided so that we can contact you to facilitate the recruitment process: your address (street, postcode, city, country), phone number, email address, Microsoft Teams, etc;
- the information you have provided to enable us to check your suitability in accordance with the selection criteria set out in the vacancy notice: education and training (diploma), work experience (job title, duration, company name, type of company and company website address (optional), main tasks and responsibilities), language and work-related skills and competences;
- the information you have provided in your CV, cover letter and/or letter of recommendation;
- the information you gave in the job interview;
- in the case of an admission test: the results of the written and oral tests;
- a record of your progress in the recruitment process.
To the extent permitted by applicable law, HS PLUS may obtain information about your education and professional skills from publicly available sources such as business and employment social media (LinkedIn or similar). In addition, we may obtain information about you from other sources, such as employers or other sites on the Internet, subject to the privacy notices of those third parties.
- Types of personal data in the context of the employment relationship:
- Employee records,
- A register of information on people working on the basis of a referral from an authorised organisation providing work for students,
- Records of information on scholarship applicants and scholarship holders,
- Records of salaries, travel orders and other monthly payments,
- Record of working time,
- Records of work-related injuries,
- Records of health checks,
- Records of training for workers.
5. Legal bases for processing personal data and purposes of processing
The bases on which we use your personal data are:
- The law – we process your personal data where the law so provides (this includes in particular the Employment Relations Act, which serves as the basis for most of the processing arising from the employment relationship or the administration of employment procedures. However, other laws may also serve as a basis, such as the Law on Labour and Social Security Records, which imposes an obligation on employers to keep records on employees).
- Contractual or pre-contractual relationship – where personal data is not processed on the basis of law, the contractual relationship that the employee has with the employer may serve as the basis for processing personal data. This may mean an employment contract or some other contract, such as an education contract. Such data may include, in particular, a private (contact) telephone number, a private (contact) e-mail address, training data, etc.).
- Legitimate interests – We may process your personal data on the basis of our legitimate interests. We will always process your personal data on the basis of legitimate interests, in particular the efficient processing of your application and the continuous improvement of our recruitment process.
- Your explicit consent – from time to time we may ask for your consent to use your personal data for one or more purposes. Whenever the legal basis for processing your personal data is your consent, we will inform you in advance.
- We will ask candidates for consent to complete certain parts of the recruitment form, and we will ask our employees for consent for various publications and processing of data related to the employment relationship. We will also ask for consent from non-selected candidates whose personal data we wish to keep for future recruitment purposes.
- When processing your personal data on the basis of consent, the provision of personal data is always voluntary and without negative consequences for you. However, please note that we may not be able to provide you with certain services without your consent or after your consent has been withdrawn (e.g. storing your personal data in order to contact you when a relevant job position opens up for you).
6. Retention period
We keep any personal data we process in accordance with the law and only for as long as is necessary to achieve the purposes for which the data were collected.
Where the retention period of personal data is prescribed by law, we shall retain it in accordance with the provisions of that law.
Where the collection and processing of personal data is based on a contract, the retention period shall be the entire period of validity of the contract, including any guarantee or other periods arising from the contract.
Where the collection and processing of personal data is based on your explicit consent, we will retain your personal data permanently or until revocation. However, in the event that the purpose for which we processed the data is fulfilled, we will delete your data even if you do not withdraw your consent.
7. Security
We apply generally accepted standards of technical and operational security to protect the personal data we process. Access to personal data is restricted to authorised personnel of HS PLUS and our external service providers (e.g. the provider of the software required to perform our recruitment and HR record-keeping processes). These employees and third-party service providers are obliged to treat this information as confidential.
We keep personal data in written form (in personnel folders, in locked cabinets) and in computerised form. Our computer systems are protected by technical and organisational measures to prevent accidental or intentional destruction, loss, damage, alteration, unauthorised disclosure or

To ensure fair and transparent processing of your personal data, you have the right to:
- request access to your personal data. This allows you to receive a copy of the personal data we hold about you and to check whether we are processing it lawfully.
- request the correction of personal data we hold about you. This allows you to correct any incomplete or inaccurate information.
- request the erasure of your personal data. This allows you to ask us to delete or remove your personal data if there is no compelling reason for us to continue processing it. You also have the right to request that we delete or remove your personal data if you have exercised your right to object to processing.
- object to the processing of your personal data where we rely on legitimate interests (or the interests of a third party) and there is something in your particular situation that makes you want to object to processing on this basis.
- request restriction of the processing of your personal data. This allows you to ask us to suspend the processing of personal data about you if, for example, you want us to establish its accuracy or the reason for processing it.
- request the transfer of your personal data to another party.
- withdraw consent where our processing of your personal data is based on consent.
Any request to exercise your rights in relation to personal data processed by HS PLUS may be made in writing to [email protected]. HS PLUS is obliged to reply to the individual’s request without undue delay or at the latest within one month. If the data subject considers that the personal data received pursuant to a request to exercise his or her rights under the previous point of this HR Privacy Policy are not the personal data he or she requested or that he or she has not received all the personal data requested, he or she may lodge a reasoned objection with HS PLUS within 15 days before lodging a complaint. HS PLUS is obliged to decide on the objection within 5 working days.
A refusal by the controller may be subject to an appeal, which is subject to the competence of the supervisory authority – the Information Commissioner.
9. Categories of users of personal data
The users of personal data are the HR department and the contract processors of HS PLUS, who are obliged to respect and protect the personal data of individuals on the basis of employment law, contracts for the processing of personal data or contracts for the protection of confidential data. Users have access to personal data in accordance with their assigned data access rights.
HS PLUS also discloses personal data to third parties if such disclosure is required by law (e.g. the Financial Administration of the Republic of Slovenia, courts, police, etc.).
